Asylum and refugees

Donald Trump has made very public threats to persecute his political opponents should he be re-elected and statements by him and by other leading Republicans suggests that he might persecute others on the grounds of their religion or their membership of certain social groups. If this were happen (rather than simply being bluster) then it could turn out, very soon, that some US citizens will find themselves outside of their country, with a well-founded fear of persecution on grounds outlined in the 1951 Refugee Convention, and on the territory of a state signatory of the Convention. Some of those states will also be allies of the US through NATO and other treaties and will have extradition treaties with the US. In which case what might happen?

  1. Currently most of the relevant states try to prevent people likely to claim asylum from arriving on their territory (and their leaders denounce those who do arrive as “illegal immigrants”). Most of the states concerned currently have visa waiver programmes for US citizens and would probably be reluctant on economic and geopolitical grounds to shut those down, although it is possible they might in response to a similar tightening by a Trump administation. So one question is whether such states will try to make it more difficult for Americans to visit. If they don’t then US citizens will find it relatively easy to escape to those countries.

‘Eating dogs’ in a world that has not lost its humanity

In an article published last year, I tried to show that our moral judgement is heavily biased when it comes to migration. For instance, an action that we regard as a minimum moral obligation towards compatriots becomes, towards migrants or foreigners, non-obligatory and even forbidden. I tried to show that even ethicists well disposed towards foreigners – cosmopolitans, so to speak – suffer from the same bias. Nationalism stifles creativity to such an extent that we are often unable to imagine doing to foreigners what it is a minimum moral obligation towards compatriots.

A few days ago, I tooted at Mastodon about a Christmas message I’d had from a Russian friend. I intended my post to convey something hopeful about peace and reconciliation, but got immediate pushback from someone who asked why, if there are are some good Russians, they haven’t stopped the war. Meanwhile, over on Elon’s death site, the theme of holding Russians collectively responsible for the war seemed to be gathering momentum with vehement assertions that this isn’t just “Putin’s war” but one backed by “the Russian people”. I think claims such as these, particularly in their maximal forms are absurd, and become all the more absurd when the alleged collective responsiblity of “the Russian people” is extended to an attitude of hostility and blaming towards individuals, simply because they hold Russian nationality. And many members of “the Russian people” are, after all, children. Yet in rejecting such absurdities, I also want to leave room for those Russians who feel their own responsbility keenly and who feel shame at the Russian government’s actions and who want to take responsibility by resisting, in great or small ways, what that government is doing.

One obvious point to make is that Russia is not a democracy and that Russian citizens have no effective means to restrain their government, even if they wanted to. Rather, they live under a tyranny, quick to mete out savage punishments to its opponents, and where public opinion is partly shaped by relentless nationalistic propaganda. In this light, one might think of ordinary Russians as being among the victims of the regime, even though there are others, most notably Ukrainians, who are suffering much more at its hands. During the Soviet era, it is worth noting, Western governments were keen to frame ordinary Soviet citizens as victims of dictatorship rather than holding them individually or collectively responsible, but this approach has been abandoned in some reponses to the war, including by Baltic politicians who refuse to accept that Russians who refuse to fight for Putin are legitimate refugees.

Book note: Sally Hayden, My Fourth Time We Drowned

A few years ago at Crooked Timber, I posted a review of Oscar Martinez’s book The Beast, about the migration route to the United States from Central America through Mexico. It was a horrifying catalogue of coercion, physical injuries, murders and rapes and one friend who read it on my recommendation told me he regretted having done so, because it was so disturbing. If anything a more horrible story is told in My Fourth Time We Drowned: Seeking Refuge on the World’s Deadliest Migration Route, by the Irish journalist Sally Hayden. It is a book that exposes the deadly migration route across the Sahara to Libya, the Libyan detention camps run by militias, and then the attempts to cross the Mediterranean that are often foiled by the EU-funded Libyan “coastguard”, that often lead to mass drownings and only sometimes to an arrival in Italy or Malta.

There are many nationalities trying to cross to Europe, but many of them, and a particular focus of Hayden’s narrative, are Eritreans. Eritrea is the most repressive state in Africa and by some measures more repressive than North Korea. The Eritreans who are trying to flee this police state are trying to escape a life of indefinite conscription, often punctuated by violence and by sexual abuse. European states, in an echo of their actions in trying to prevent Jews from fleeing Germany in the 1930s, act so as to make it as difficult for people to escape as possible. In doing so, they empower and enrich both the people smugglers who treat these escapees as exploitable assets and the various militias who run detention camps within Libya.

As they make their way across the desert, where many are abandoned and die, migrants fall into the hands of smugglers to whom they may already have paid a fee. They are held and their relatives receive pictures of them demanding more money for their onward transit, pictures of sons and daughter being tortured that resemble for all the world those pictures of Abu Ghraib. The smugglers who hold them in these coralls, not only torture for money and recreation, they also rape large numbers of the women held there.

I was reading a book on migration ethics recently – I may write a review later 1 — and it reminded me how a certain picture of the normal liberal state and its place in the world figures in a lot of political philosophy. Although the normative arguments are supposedly independent of historical facts, history is to be found everywhere, but only in a highly selective version that reflects the dominance of the United States within the discipline and the prominence of prosperous white liberals as both the writers of the important texts and as the readers and gatekeepers. 2 Their assumptions about the world and the US place in it shine through and form a "common ground" that is presupposed in much of this writing.3

In this vision, all the world is America 4 — though not one that corresponds to the actual history of the US — and the rest of the world mostly consists of little proto-Americas that will or should get there in the end (thereby echoing Marx’s dictum that the more developed country shows the less developed one a picture of its own future). This imaginary, but also not-imaginary, state is a sort-of cleaned-up and aspirational version of the actual one, cleansed of embarrassing details that are mere contingencies that detract or distract from what US liberals suppose to be its real essence or telos. Crucially, it is also considered as a basically self-contained entity, where all the important relationships are ones among people on the territory.5 It is an association of free and equal persons that has simply arisen on virgin soil. Both the actual United States and other countries fall short of this model, of course, but with time and good will wrinkles and carbuncles will be removed. 6

War – what can we do?

I recall that a few years ago, when Israel bombed the Gaza strip in the middle of the (Northern Hemisphere-) Summer, I felt angry and powerless. People, locked up in what was essentially an open air prison, had nowhere to escape or hide. The war in Syria similarly has led to horrible suffering. There have been many other wars or armed conflicts, but most of them hardly receive sustained reporting. And now there is the Russian war in Ukraine.

I am sure many of you ask, in such circumstances: “What we can do?” And I’ve heard some say “There is nothing we can do”. But that is not true. I’ve come up with the following answer to that question for myself, and am interested in learning how you answer that question for yourself. On seeing Astra Taylor’s What is Democracy?

I went to see occasional Timberite Astra Taylor’s remarkable film *What is Democracy?* last night. It takes us from Siena, Italy to Florida to Athens and from Ancient Athenian democracy through the renaissance and the beginning of capitalism to the Greek debt crisis, occupy and the limbo life of people who have fled Syria and now find themselves stuck. It combines the voices of Plato and Rousseau with those of ordinary voters from left and right, Greek nationalists and cosmopolitans, ex-prisoners, with trauma surgeons in Miami, Guatemalan migrants in the US, with lawmakers and academics, and with refugees from Syria and Afghanistan. All the while it poses the questions of whether democracy is compatible with inequality and global financial systems and the boundaries of inclusion.

Some of the testimonies are arresting: the ex-prisoner turned barber who tells us of his nine years in a US prison of a hunger strike when the authorities tried to take the library away and of his problems adjusting to life of the outside, to being around women, and the fact that he’s denied the vote. And all the time he’s telling you this with attention and passion he’s clipping a customers beard, which adds a note of tension. We hear from trauma surgeons who tell us of the levels of violence in Miami – so much blood that the city is used for training by medics from the US military – and the shock of cycling from one neighbourhood to the next and experiencing swift transitions from opulence to utter destitution. We hear from a young Syrian woman who relates how she had to leave Aleppo after her mother was wounded by a stray bullet in her own home and whose idea of democracy is a country where she can lie safely in her bed.

Crowdfunding for Bristol Refugee Rights

Crooked Timber community! I write to tell you about a charitable organisation that I’m involved with (I’m Chair of the Board of Trustees) and its current fundraising initiative. The charity is [Bristol Refugee Rights](http://www.bristolrefugeerights.org/), and we provide welfare, advice and education services, as well as a place to hang out and a hot meal for refugees and asylum seekers in the Bristol area. One of our services is our Early Years Project, which provides a creche for the children of refugees, which is particularly useful to enable their parents to attend classes to learn English or access our other services. It also provides a nurturing environment for small children who have had a really rough start in life and whose families are often subsisting at near destitution levels, as the British government only assists them to the tune of £5.32 a week (and some have less or nothing) on top of their housing in, again, very poor conditions. We need money to keep the service running and do things like pay the wages of the staff who run the creche. If you can, please give generously.

Asylum-seekers have to eat too

The Guardian has [a piece today on the asylum-system in the UK](https://www.theguardian.com/world/2017/apr/09/its-a-shambles-data-shows-most-asylum-seekers-put-in-poorest-parts-of-britain), attacking the policy whereby asylum-seekers are dispersed to areas of the country with a lot of empty and cheap housing on the grounds that this is burdensome to poor areas and that Labour-controlled local authorities have to host more people than Tory ones do. The entire drift of the piece is to see asylum-seekers as a cost unfairly imposed on poor communities, and an [accompanying article about Rochdale](https://www.theguardian.com/world/2017/apr/09/rochdale-town-conflicted-large-asylum-seeker-population), represented by Simon Danczuc MP (the sort of Labour MP who goes drinking with Nigel Farage), has the predictable white working-class local complaining:

>“[Immigrants] get everything given to them, everything for free; I don’t get anything. It just seems to me that the working class, working people, are being hit the hardest by immigration.”

Well, there’s an obvious point to be made, both to him and to the authors of the main article. Asylum-seekers are provided with accommodation that nobody else wants and made to live on £5/day. If they got more then our bitter member of the “white working-class” would complain more about the unfairness, but if you are going to have to live on that kind of money they you had better not be made to live in Kensington and Chelsea. I’d support increasing the allowance (a lot) for asylum seekers, maybe making it variable depending on area of the country, providing more resources to local authorities to help with schooling and permitting asylum-seekers to work (banned by Labour). Apart from giving more money to local authorities, none of these sensible changes is backed by Labour, no doubt worried about being seen to give people “something for nothing”, yet they are essential if you are going to have anything like a different system of geographical dispersal. There is the further issue, of course, that many of the asylum-seekers are in fact refugees who the government hasn’t got round to recognizing as such yet, and keeping refugees in limbo for years is a stain on the UK’s human rights record.

Snitching on those in breach of immigration law

Kwame Anthony Appiah, of whom I have only had positive feelings up to now, [has produced an opinion for the Ethicist column for the New York Times](https://www.nytimes.com/2017/01/25/magazine/should-you-report-a-green-card-marriage.html) that it is “a good thing” when citizens report violations of immigration law to the US authorities. He produces this opinion in the context of a question about “green-card marriage” entered into merely in order to gain an immigration advantage, so it is unclear how far he relies on the specific features of the case he describes to generate a more general moral conclusion, but I, for one, find his reasons highly problematic.

First, he operates on the assumption that US migration policy is reasonable and reasonably fair and that states have the right to set their immigration controls unilaterally. Whether or not legitimate states have the right to set their immigration controls unilaterally (I’m a sceptic), I think it hard to argue that US policies are currently fair given who they exclude (and *a fortiori* who they are now excluding). Appiah argues that people who enter by unlawful means are queue jumpers who thereby act unfairly towards others. But the very idea that there is an immigration queue that people can join and wait their turn is preposterous. There is no such queue and many many people will never be in a position where they can realistically have a chance of a visa. The claim of unfairness to other would-be migrants is therefore unfounded.

Conscription and the media narrative on refugees

The world is watching the denouement in Aleppo, with stories emerging of massacres, particularly of young men (and probably by young men). A [story I read from Patrick Cockburn in the Independent](http://www.independent.co.uk/voices/aleppo-fall-latest-syria-civil-war-bombardment-bashar-al-assad-rebels-advance-a7470716.html) reported that such is the shortage of manpower for the Syrian army that other young men, emerging from eastern Aleppo, are being immediately conscripted into the Syrian army. A Syrian refugee I heard speaking the other day said there was no choice but to leave because you would either be killed, or you would be forcibly enlisted and forced to kill others. And many of the young Eritreans who find their way to Europe are also fleeing conscription (they face indefinite military service). This is hardly a new thing. The last major exodus of Americans fleeing the jurisdiction of their state was of young men who were evading the Vietnam draft.

James C. Scott, in his wonderful [*The Art of Not Being Governed*](http://yalebooks.com/book/9780300169171/art-not-being-governed) writes of state conscription as one of the main reasons why the subjects of states flee to the hills, to a zone outside of state control. There are few such zones today, and those that there are may be governed by forces even less appealing that the states that conscripts are fleeing from.

This all got me thinking about some of the media narrative on refugees over the past few years. The preponderance of young men has been treated by those who want to keep refugees out as a reason for suspicion. The “genuine” refugees for the newspaper columnists are mothers and children. It is the toddler drowned on the beach, like Aylan Kurdi, who elicits public sympathy. But young men are often the ones with most reason to flee. It is they who face the starkest choice between killing and being killed. No wonder they predominate.
