When journalists write articles about whether countries are free or not, as with this piece in the Financial Times by Martin Wolf about India, they often rely on the ratings from Freedom House. Reading Wolf’s article, my interest was piqued concerning what Freedom House says about the post-Brexit UK, and specifically for the freedoms that it classes as “civil liberties”. Given that one recent major study — Chandran Kukathas’s Immigration and Freedom — makes a compelling argument that immigration restrictions involve extensive restrictions on everyone’s liberty, I was interested to see how this would be reflected both in Freedom House’s criteria and in its use of those criteria in country reports.

First of all then, Freedom House’s methodology. There would seem to be several relevant parts:

F4. Do laws, policies, and practices guarantee equal treatment of various segments of the population?

Do members of such groups face legal and/or de facto discrimination in areas including employment, education, and housing because of their identification with a particular group?

As I’ve discussed before on Crooked Timber, and as is extensively documented by Amelia Gentleman in her book The Windrush Betrayal, the UK’s hostile environment legislation, pioneered by then Home Secretary Theresa May, had the effect of denying to many people, particularly of Caribbean origin, employment, housing and health. Many children born to immigrants in the UK are denied access to higher education because of restrictive nationality laws.

Disinformation and the Intercept

There’s a backstory behind this Washington Post story on Republican persecution of academics, and it’s one that doesn’t make the Intercept look good.

Jordan’s colleagues and staffers met Tuesday on Capitol Hill with a frequent target of right-wing activists, University of Washington professor Kate Starbird, two weeks after they interviewed Clemson University professors who also track online propaganda, according to people familiar with the events. Last week, Jordan (Ohio) threatened legal action against Stanford University, home to the Stanford Internet Observatory, for not complying fully with his records requests. … The push caps years of pressure from conservative activists who have harangued such academics online and in person and filed open-records requests to obtain the correspondence of those working at public universities. The researchers who have been targeted study the online spread of disinformation, including falsehoods that have been accelerated by former president and candidate Donald Trump and other Republican politicians. … Last month, the founder of the conspiracy-theory-prone outlet the Gateway Pundit and others sued Starbird and Stanford academics Alex Stamos and Renée DiResta, alleging that they are part of a “government-private censorship consortium” that tramples on free speech. …
“Whether directly or indirectly, a government-approved or-facilitated censorship regime is a grave threat to the First Amendment and American civil liberties,” Jordan wrote.

The claim that these academics are part of a “government-approved or-facilitated censorship regime” is complete bullshit. But it is bullshit that was popularized by a grossly inaccurate story at the Intercept, which purported to discover a secret collaboration between academics and DHS to censor the American right wing. Book note: Sally Hayden, My Fourth Time We Drowned

A few years ago at Crooked Timber, I posted a review of Oscar Martinez’s book The Beast, about the migration route to the United States from Central America through Mexico. It was a horrifying catalogue of coercion, physical injuries, murders and rapes and one friend who read it on my recommendation told me he regretted having done so, because it was so disturbing. If anything a more horrible story is told in My Fourth Time We Drowned: Seeking Refuge on the World’s Deadliest Migration Route, by the Irish journalist Sally Hayden. It is a book that exposes the deadly migration route across the Sahara to Libya, the Libyan detention camps run by militias, and then the attempts to cross the Mediterranean that are often foiled by the EU-funded Libyan “coastguard”, that often lead to mass drownings and only sometimes to an arrival in Italy or Malta.

There are many nationalities trying to cross to Europe, but many of them, and a particular focus of Hayden’s narrative, are Eritreans. Eritrea is the most repressive state in Africa and by some measures more repressive than North Korea. The Eritreans who are trying to flee this police state are trying to escape a life of indefinite conscription, often punctuated by violence and by sexual abuse. European states, in an echo of their actions in trying to prevent Jews from fleeing Germany in the 1930s, act so as to make it as difficult for people to escape as possible. In doing so, they empower and enrich both the people smugglers who treat these escapees as exploitable assets and the various militias who run detention camps within Libya.

As they make their way across the desert, where many are abandoned and die, migrants fall into the hands of smugglers to whom they may already have paid a fee. They are held and their relatives receive pictures of them demanding more money for their onward transit, pictures of sons and daughter being tortured that resemble for all the world those pictures of Abu Ghraib. The smugglers who hold them in these coralls, not only torture for money and recreation, they also rape large numbers of the women held there.

What’s wrong with “cancel culture”?

“Cancel culture” has recently been in the news as a threat to free speech and open debate, most notably with the publication the other week of that open letter in Harpers. Cancelling is essentially a kind of crowdsourced attempt to boycott and ostracise individuals for their words or actions, sometimes including calls for them they be fired from their jobs or denied contracts and opportunities by media organisations. In the democratic space of social media this can sometimes tip over into unpleasant mobbing and sometimes bullying. But is “cancelling” people always wrong? Is the practice always an attack on the norms of free speech and open debate? Might cancelling some people be necessary to ensure others get the voice and platform to which they are entitled?

One objection to “cancellation” is that it chills open debate and makes people self-censor. But the problem with this critique is that some speech should be chilled and sometimes people ought to self-censor. A society that refuses to tolerate speech like David Starkey’s recent racist remarks about “damn blacks” and the slave trade is better for it, and it is a pity that Starkey didn’t think twice before uttering them. Now that he has come out with such language, he’s been cancelled, and rightly so.

At a time when coronavirus dominates the headlines, other news struggles to get out. Yet one piece of news deserves to get a much wider hearing, namely, the story of how Labour full-time officials opposed Jeremy Corbyn’s leadership of the party to a degree where they preferred the party do do badly in elections. The same party officials were responsibly for feeding contacts in the media a constant drip of anti-Corbyn leaks, particularly around anti-semitism and Corbyn’s alleged failure to deal properly with complaints. Now a leaked internal party report, commissioned during Corbyn’s time in office, has revealed some of what went on and much about the attitudes and behaviour of senior Labour staffers, particularly during the 2017 general election when Labour did better than expected and denied the Tories a majority. The details revealed are very shocking although perhaps not surprising to anyone who had encountered these individuals or others like them in student politics in earlier decades. Essentially, they regarded themselves as the true guardians of legitimate mainstream Labour, understood as being very right-wing social democratic indeed (probably well to the right of former leader Ed Miliband and possibly his predecessor Gordon Brown) and believed that the elected leadership of the party and the majority of the membership were illegitimate. The epithet frequently used is “trots”. They devoted their time to rooting out from the party those on its left by trawling social media for statements that could justify exclusion (perhaps someone just “liked” a tweet by the Green Party). In communications (including to a private WhatsApp group) they gave full rein to their attitudes and even violent fantasies about those they hated, expressed hostility towards Muslims and solidarity with journalists who promoted an Islamophobic agenda. During the 2017 election campaign, they diverted resources from marginal seats towards candidates they approved of, expressed dismay at any good polling results, and when the actual results started to come in were angry and disappointed that the party had done well. Following that election they redoubled efforts to destroy Corbyn’s leadership.

Cults

A while ago I was helping a couple of students decide what to register for the following semester. One of them had discovered a class in Religious Studies called “Sex and Cults” which the other student and I thought sounded thrilling, and were very disappointed to discover we had been mishearing, and it was in fact just “Sects and Cults”. Even so, I’ve long had an interest in cults (and sects), so I’d like to recommend a couple of great podcasts about cults (partly in the rather forlorn hopes of someone being able to offer me something else equally good).

End Of Days is a BBC documentary about the Branch Davidians, told from the British perspective: 24 Brits, all recruited from the Seventh Day Adventists, and almost all of them Afro-Carribean in origin, died in the conflagration. The reporter seems particularly incomprehending that Brits could end up in a cult in Waco, as if there is something in the national DNA that immunizes us from such gullibility, which might irritate some listeners, as might the slightly superior attitude toward the Americans they meet. And he is exceptionally unsympathetic to the cultists and, for example, is remarkably uncritical of the idea the idea that the cultists were brainwashed. The phrase “Whackos of Waco” is repeated much too often! But it is well worth listening all the way through: its a compelling story, well told, you get a real sense of the ways in which it was tragic for those left behind. They trace the role of, and interview, a remarkable and rather sinister character, Livingstone Fagan, who helped Koresh recruit and whose wife and mother, whom he refuses to mourn, were killed in the fire. They deal particularly well with the siege and conflagration: as with all accounts I’ve heard its hard to escape the conclusion that the ATF and FBI were spectacularly irresponsible.

Better still is Glynn Washington’s series about Heaven’s Gate. Washington was, himself, raised in a cult which, I think, helps him understand the state of mind of the cultists much better than the makers of End Of Days. The end is, of course, the starting point for the investigation, but whereas the BBC documentary maintains consistent focus on the conflagration, for Washington the end is just the end. He traces the whole history of the cult, interviewing people who knew Marshall Applewhite and Bonnie Nettles before they became cult leaders, and many former members and friends and family of those who died. Whereas Koresh lived very differently from his followers (he, and they, believed he was the second coming of the Messiah and, oddly given what we read in the Bible, thought that entitled him to sex with any woman, or girl, that he wanted). Applewhite lived just like them — he was one of the several men who underwent voluntary castration to affirm their ascetic lifestyle. (Nettles who, it becomes clear, was the true leader, pretty followed rules that all were expected to abide by while she was alive, with one notable exemption that Washington teases out). Nettles and Applewhite were clearly in love with each other but seem to have remained celibate. Washington goes much deeper into the psychology of cult membership, and devotes an entire episode to the ethics of deprogramming and whether brainwashing is real. Much more than End of Days, Heaven’s Gate gives you a feel for what life was like for the followers.

If you can recommend other long form podcasts about sects and cults (or even sex and cults), go ahead!

Who has any use for conservative intellectuals?

The firing of Kevin Williamson has led, predictably, to outrage from other conservatives, and in particular from anti-Trumpers like Bill Kristol and Erick Erickson. I can’t help thinking that much of their outrage is rooted in fear. Conservative intellectuals are in a very awkward historical position.

It is an unfortunate, but fairly obvious truth that most intellectuals, both on the left or right, don’t have particularly original ideas. Go to the Aspen Ideas Festival, or TED, or any of their ilk and you won’t find much that is genuinely surprising or exciting. Instead, you will find a lot of people whose stock-in-trade is not so much innovation as influence.

This used to be true in some quite specific ways of conservative intellectuals. The conservative movement perceived the need for intellectuals, both to hold their own fractious coalition together through ‘fusionism’ and the like, and to justify their goals to liberals, who dominated the space of serious policy discussions, and could possibly stop them. Liberal policy types, for their part, needed to understand what was happening among conservatives, and perhaps hoped to influence it a little. The result was that conservative intellectuals were in a highly advantageous structural position, serving as the primary link between two different spheres, which didn’t otherwise come much into contact. As network sociology 101 will tell you, this allowed them a fair amount of arbitrage and enough slack that e.g. people like Jonah Goldberg were treated as serious thinkers.

Now, however, the game is up, thanks to an unfortunate concatenation of events. Conservative intellectuals defected en masse from Trump, thinking that it was a fairly cheap gesture of independence, but Trump got elected. Not only did this damage these intellectuals’ personal ties with the new administration and the conservative movement, but it opened up the way for a conservatism that basically didn’t give a fuck about policy ideas and the need to seem ‘serious’ any more. The result is that conservative intellectuals don’t have all that much influence over conservatism any more.

The problem is that without such influence over conservatives, these intellectuals’ capital with liberals and the left is rapidly diminishing too. If conservative intellectuals don’t have much of an audience within conservatism itself, why should people on the opposite side listen to them any more? Their actual ideas are … mostly not that strong. Some of them are good writers (David Frum, for example), but good writing only goes so far. The only plausible case for paying attention to conservative-intellectuals-qua-conservative-intellectuals, is that perhaps the pendulum will swing back after Trump, and the old regime be restored. That might happen, but you wouldn’t want to betting serious money on it.

If this analysis is right (and it obviously may not be) Stephens, Williamson (up until this afternoon) and the others are running on fumes. The adherents of old-style centrist liberalism might still have some nostalgia for the old days when men were real men, women were real women, and associate editors of the New Republic were real associate editors of the New Republic. But that’s a poorish substitute for actual influence and an actual audience, especially when the actual liberals and leftwingers that are the audience for publications like the Atlantic don’t want anything to do with these people. The very brightest will probably be OK – but it’ll be a cold enough future for the others.

No, But We Have a Word For That, Pt 2

Right, so, The NYT has an article on how DNA analysis is helping African-Americans learn about their family history. The author’s grasp on the English language seems to slip away from them at one point (originally two), though. Exhibit A:

Buried in DNA, the researchers found the marks of slavery’s cruelties, including further evidence that white slave owners routinely fathered children with women held as slaves.

MmmmmmOK. This one was changed in an update! Because it sucked before:

The researchers observed that the X chromosome of African-Americans has a greater African ancestry than other chromosomes. Dr. Gravel and his colleagues believe this variation is explained by European men and African women producing children — in other words, slave owners raping the women they held captive.

Thanks for explaining what happens when a rape victim and her rapist “produce children”! Because rape is totally the exact actual word we should use when someone coerces someone else into having sex with him against her will. That might be mebbe by, like, standing right over the person with an axe handle, or else could be something more like keeping your own children enslaved in America so that she couldn’t escape you in France (coughJeffersoncough).

Now, I do understand that people have a general unwillingness to say things like, “noted statesman and confirmed serial rapist Thomas Jefferson exercised extraordinary taste in designing his home.” It just…it just sounds real, real bad. But when talking about slaveowners generally, what is with the “fathered children” thing? Or, let’s grant that people are reluctant even to say that about such a huge number of white citizens often thought to be morally adequate in some vague way as a class (I’m not really seeing it, but, eh.). Nonetheless, even when it comes to the most universally loathed men in the world, like Josef Fritzl, I have noticed a strong inclination for writers to say that someone “fathered children with” their rape victim. At the time of the case, particularly, I found it disturbing to read these words so many times: “fathered children.”

John’s hypothesis was that, to some degree, the rapine part of slavery is baked into the enslavement, with the result that further rape doesn’t seem like the most salient thing? (He was not looking for weird justifications for this abuse of language, just speculating.) About abductors…mmm…same, sort of? Like, the kidnapping is the part where volition goes out the window, and then all further activities are assumed to be unwilling and there’s therefore no need to specifically say raped many times afterward? But I don’t hear it that way. Quite the opposite. Rather, it seems as if people think you can only be raped so many times before…something other than rape is taking place? Or, perhaps, the “was she kicking and screaming” element that is meant to pick out rape rape infects the way people discuss rapes that don’t involve physical violence every single time?

I can easily imagine a lived complexity in which Sally Hemings had some power in her relationship with Thomas Jefferson, emotional power or even sexual power of a kind. But this is something for a novelist to talk about–a journalist or historian needs to say “raped” again even for the 200th instance of forced sexual relations. And “fathered” is just weird and messed-up sounding, redolent of horse-breeding. I do feel things have improved in the last five years. I notice it particularly in reading sites like the (nominally?) feminist Jezebel–commenters will always correct quoted articles of this kind to include the word rape, and I do feel people notice.

“Buried in DNA, the researchers found concrete evidence of slavery’s cruelties, including the fact that enslaved women often became pregnant as the result of being repeatedly raped by their white masters.” Is that even any harder to say, or is it just more unpleasant to read? Thoughts?

The English columnist Nick Cohen had [a piece on immigration in yesterday’s Observer](http://www.theguardian.com/commentisfree/2016/feb/06/liberals-harsh-truths-help-refugees-syria). For those who don’t know his work, Cohen is a former left-wing radical journalist who has now renounced “the left” for its supposedly regressive views and who, post-epiphany, lashes “liberals” and others in the pages of the Spectator and Standpoint. A Paul Johnson for a new generation.

His latest effort is full of his trademark jibes that “the left” is soft on Putin, together with swipes at stock figures such as the “no-platforming student dogmatist”. But let’s leave the fluff and the fury aside and concentrate on the substance of his piece.

Lynsey Addario’s autobiography, recommended

I spent a good chunk of yesterday reading the second half of Lynsey Addario’s [*It’s What I Do: A Photographer’s Life of Love and War*](http://itswhatidobook.com/). I’d been reading it a few pages at a time for the previous week, but then I just got carried away and had to read right to the end. As CT readers know, I’m keenly interested in photography, but it is also the case that reading accounts from war photographers (and seeing their pictures) has changed the way I think about war and conflict.

After September 11th 2001, the blogosphere erupted into being a thing, and several hundred part-time pundits spent a good period of their time arguing with one another about Afghanistan, Iraq, the Islamic world, military tactics and a thousand other things they knew virtually nothing about. Some of them are typing still. I penned what I now regard as an unfortunate essay on just war theory and Afghanistan, unfortunate because there I was applying abstract principles to conflicts where I hadn’t a clue about the human reality. I hope I’d be more careful and less reductive today, and that’s partly as a result of people like the photographer Don McCullin, and his autobiography *Unreasonable Behaviour*. I’d heard of Addario’s book a few months ago, but then I saw some of her pictures at a festival of documentary photography in Perpignan, France, and decided I had to read it.

By now you’ve probably heard that Jonathan Chait has written an article for New York magazine decrying modern liberalism for becoming little more than a series of Twitter-based convulsions of outrage. You may have heard that he has a point there. Or maybe you heard it was an argument against Political Correctness–a dragon from 1991 who has reared up wearing a crop top, ’70s jeans and 14-hole Doc Marten’s, and is taking the pain of her infected belly-button piercing out on others in inappropriate ways–and the reign of terror this dread P.C. has engendered in liberal academia. Or maybe you heard that a previously moderately well-regarded author has gone to the #slatepitch side of the Force. Or, perhaps, that Jonathan Chait has a skin so thin that he cries when someone gets the butter knife out of the drawer anywhere within six blocks of his apartment, and is also so allergic to his own tears that he then needs to use his EpiPen and ARE YOU HAPPY NOW BLACK FEMINISTS!?!1/1//! Unfortunately for Jonathan Chait, modern liberalism, the state of the publishing industry, feminism, concerns about racial equality, the extent to which previously marginalized voices can now pipe up and be heard in critical discourse, and all of us, it’s actually that last thing.

But what about his maybe having a point? The thing is, Chait has about 75% of perhaps two points, but the wheat/arsenic-laced chaff ratio is bad. Very bad. How so? The article is actually about how his feelings got hurt by people who say mean things on the internet–in the sense that this is the actual motive for writing it. ‘They claim to be too sensitive to take criticism or even hear discussion of sensitive topics, and that shuts down debate!’ whines sensitive man whose feelings have been hurt by criticism from the internet. ‘They are destroying our political project and they won’t even listen to my concern trolling crucial critique because I am…a white man!‘ [Faints on couch.] How did New York Magazine tease this article? “Can a white, liberal man critique a culture of political correctness?” Spoiler alert: YES.

Krautmas only comes once a year …

But here are two belated presents – take your choice as to which one you put beneath your poisonwood tree.

“George Scialabba”:http://www.georgescialabba.net/mtgs/2014/05/floats-like-a-vulture.html tries to see (as George always does), the good side.

For the tragic waste of Krauthammer’s considerable talents represented by Things That Matter, a good deal of the blame should doubtless go to the bad habits fostered by op-ed writing and talk-show commenting. Krauthammer is an expert simplifier, summarizer, and close-quarters scrapper. His skill at producing zingers is enviable. But remarks are not literature, and zingers are not political wisdom. You can’t surprise yourself, breathe deeply, get to the bottom of things in 800 words or 20 seconds.

By and large, the quality of the eighty-eight pieces in Things That Matter is proportional to their length. Hearteningly, Krauthammer mentions that he is, at long last, writing a book: two books, in fact, one on domestic policy and one on foreign policy. Perhaps in the course of them he will, at least occasionally, surprise himself and us, vindicating Mill’s generous hope.

It’s a tribute to our nation’s culture that a man like Krauthammer, who so consistently expresses blatant quantitative falsehoods about national leaders, is not only out of jail but comfortably established as a commentator for a major media outlet.

Down the MOOC-hole, where I have been, I haven’t kept score in the Silver/Krugman kerfuffle. But, Plato-preoccupied as I was, I did make a false inference. I knew it was some fox-hedgehog thing. Silver was using Archilochus to frame what is wrong with standard opinion journalism. Perfect! I thought. Because I have read Plato’s Republic.

Back when Nick Confessore broke the Tech Central Station scandal, another journalist wrote a “very good piece”:http://talkingpointsmemo.com/edblog/–98649 about the problems that you got when journalism merged into astroturfing.

It was because this article — ‘Meet the Press’ by Nick Confessore — was about to be published by The Washington Monthly.

That journalist was Joshua Micah Marshall of Talking Points Memo. Anyone Remember Tech Central Station?

Josh Marshall isn’t Glenn Reynolds – the sponsorship is public and I imagine that there’ll be some quality control. But still, PhRMA’s agenda on innovation involves some very, very shitty stuff indeed. There are a whole bunch of big sleazy lobby groups on Capitol Hill, but PhRMA is arguably the sleaziest.

And in that spirit, I’d like to introduce a very cool new non-sponsored section myself, “Bullshit Lab: Impact,” focused on the very cool ways in which PhRMA lobbying is affecting real human lives and impacting people and communities living on the margins of global wealth and on the margins of the technological transformations.
