On the alleged failure of “liberal progressivism”

The other day, [an article by Chris Deerin](http://capx.co/its-official-western-politics-is-now-defunct/), a writer for the Scottish Daily Mail, appeared on my twitter timeline, retweeted and endorsed by several people I respect. The article argued Trump and Brexit mean that “liberal progressives” have lost and that “the model that has more or less dominated Western politics for the past three decades is defunct. It could not be more dead.” “We” misused that hegemony and are responsible for our own downfall:

> We used our hegemony to take down barriers and borders, to connect and build, to (yes) line our own pockets and smugly luxuriate in the goodness of our ideas and intentions. Meantime, we forgot about those who weren’t able to take part, who weren’t benefiting, to whom free trade and open borders meant greater hardship and uneasy cultural compromises. Or, let’s be honest, we didn’t forget – we just chose to conveniently ignore. We stopped asking for their permission, ploughed on through the warning signs, and fell off the end of the road.

Now “liberal” is a funny old word, mostly used as an insult these days by the Jacobin crowd on the one hand and conservatives on the other. Still, I can’t help but feel that my politics is being condemned here as infeasible and dead whilst wondering whether it is in fact true that I’ve enjoyed such “hegemony” for the past 30 years, because that certainly doesn’t gel with my experience.

The lost world of Albert Kahn

There’s nothing like a few unexpected days at home to allow you to discover new things, and the great find of the past few days — thanks to a tweet from Fernando Sdrigotti @f_sd — has been to watch (via Youtube, start [here](https://www.youtube.com/watch?v=vpijOSSlZCI) five programmes in all) some BBC documentaries about Albert Kahn and his Archives of the Planet, now preserved at the [Musée Albert Kahn](http://albert-kahn.hauts-de-seine.fr/) outside Paris. Born in Alsace, Kahn was displaced by the Prussian seizure of the territory in 1871 and became immensely rich though banking and investing in diamonds. But he was also an idealist, convinced that if the various tribes of humanity only knew one another better they would empathize more and would be less likely to go to war. In pursuit of this hope, and taking advantage of the Lumière Brothers’ [Autochrome](https://en.wikipedia.org/wiki/Autochrome_Lumi%C3%A8re) colour process, he sent teams of photographers to all parts of the globe and, before the First World War, caught many forms of life on the edge of being swept away by globalisation, war and revolution. (There’s quite a good selection [here](http://www.afar.com/magazine/a-trip-through-time) but google away.) Pictures taken around the Balkans, for example, depict the immense variety of different cultures living side-by-side at the time and then later we see the sad stream of refugees from the second Balkan War as they head from Salonika towards Turkey. Kahn’s operative document rural life in Galway, harsh penal regimes in Mongolia, elite life in Japan and a tranquil Rio de Janeiro with little traffic and few people.

Kahn’s hope for a peaceful world was lost in 1914, but we owe to his project many images of wartime France, particularly the life of ordinary people behind the lines. Postwar, Kahn was a great supporter of the League of Nations and, again, his operatives were on hand to document many of the upheavals of the inter-war years, such as the burning of Smyrna in 1922 (as Izmir, the city is once again crowded with refugees today) and the abortive attempt to found the Rhenish Republic in 1923. Many of the photographs are included in a book by David Okuefuna, *The Wonderful World of Albert Kahn: Colour Photographs from a Lost Age* (BBC Books, 2008). Sadly, Kahn was ruined by the Great Depression and died in Paris shorly after the Germans invaded in 1940. He seems little-known today, but there’s a lot of material out there that’s worth your time.

Nauru, Australia’s shame

The Guardian today [publishes a vast number of leaked reports from Nauru](https://www.theguardian.com/australia-news/2016/aug/10/the-nauru-files-2000-leaked-reports-reveal-scale-of-abuse-of-children-in-australian-offshore-detention), one of Australia’s offshore processing sites for asylum-seekers (in reality, a camp for the indefinite detention of asylum-seekers). The reports, or “unconfirmed allegations” as the Australian government would have it, are a harrowing catalogue of physical and sexual abuse, and of consequences for mental and bodily well-being, often suffered by children. These places exist to appease an Australian citizenry hostile to the arrival of “boat people” who believe that such people — even those determined to be refugees by Convention criteria — are not their problem. Though Nauru is a particularly vile example, it would be wrong to think that Australians are alone in their attitudes to refugees and asylum seekers. Other Western governments are happy to do deals with other states beyond their borders to ensure that the wretched of the earth are out of sight, where they can exist as an abstraction, not disturbing the conscience of their own citizens. Human rights, together with other liberal principles like the rule of law, have become, for many liberal democratic states, the exclusive right of the native-born citizen or, at best, someone else’s problem, somewhere else.

I’d be interested to learn from people in Australia now, how much traction this latest leak is getting in the Australian media. A surf to the websites of the Australian and the Sydney Morning Herald suggests not much.

Peter Singer demonizes refugees as “queue jumpers”

Peter Singer, consequentialist philosopher and patron saint of “effective altruism” [has expressed himself](https://inews.co.uk/essentials/news/politics/peter-singer-need-think-right-asylum/) on the question of rights to asylum and refugee status:

> Singer has urged a rethink of global asylum policy. He wants to stop refugees able to travel to the country of their choice from being able to claim asylum at the expense of those unable to make the journey. He worries that the current system enables people to “somehow jump the queue” – adding that although Britain has a “moral obligation” to accept refugees, this does not include everyone who makes it to the UK.

> “I don’t think Britain has a particular obligation to accept those who manage to set foot on British shores,” he tells i. “I think something needs to be rethought about this idea of the right of asylum as it’s now being applied.”

> The same goes for his homeland, Australia, he adds, where the government is often criticised for not taking in more Rohingya refugees fleeing persecution in Burma. “Taking those who manage to get on boats to Australia provides an incentive to make these dangerous journeys during which some get drowned. [The refugees] in the UNHCR camps in Lebanon or wherever are in just as much need of a place to go as the people who are landing in Australia or Greece.”

Here, the perfectly valid point that the those in refugee camps in poor countries are just was worthy of help as those who arrive in rich ones is placed in service of the demonization of those who arrive in boats as “queue jumpers” and the endorsement of the ridiculous argument of right-wing politicians about “incentives” to make dangerous journeys. The reason people make those dangerous journeys is because the governments of wealthy countries, using mechanisms such as carrier sanctions and visa restrictions, have blocked safe and inexpensive routes of escape from dangerous places. They do this not in the service of a fair conception of the distribution of humanitarian burdens but because they don’t want to deal with the numbers and would prefer to maintain the existing unfair distribution where most refugees are in poor countries. Singer is correct that we can distinguish between the right to asylum and the right to settle in a particular place. Perhaps when the governments of wealthy states are willing to have a proper discussion about what a fair pattern of settlement would look like, we can also reassess other elements of the system. Pending that commitment to justice on the part of the wealthy, stigmatizing those who make it across from Libya, Turkey or Haiti as “queue jumpers” is the mark of someone who has lost his moral compass.

At the moment, I’m reading my way through David Miller’s new *Strangers in our Midst* and also getting very exercised about the UK’s Brexit referendum (to the point where I’m waking at night and worrying about it). My siblings and I have all benefited from the EU’s free movement rights, my children both have non-British EU partners, we think of ourselves as Europeans. So for me, the threat of Brexit is a threat of lost identity, of something that has been there all my adult life just disappearing overnight. And so I’m feeling pretty resentful towards my fellow citizens who might vote to cut that tie and thereby endanger the security and family life of millions of EU citizens in the UK and UK citizens elsewhere in the EU.

One of Miller’s arguments is a familiar one about social trust, about how welfare states depend for their stability on such trust and that the increasing diversity that immigration brings tends to undermine support for redistributive programmes. This lack of trust gets expressed in anger about stories that immigrants are ahead in the queue for social housing, that they are a drain on health and education services, that they are getting “something for nothing”, and so forth. Needless to say, most of such stories are false. Nevertheless, there may be elements in the design of the UK’s welfare state and its relatively non-contributory character that fuel such anxieties.

Here’s the thing. Those voting for Brexit out of resentment against immigration are disproportionately the elderly poor whites who don’t pay much in but who benefit from those public services. A predictable consequence of them getting what they want is that the fiscal base for those services will be eroded and that either they will have to be cut or taxes will have to be increased. This is because those EU immigrants are, in fact, paying more in taxes than they are taking in services. (Actually, the UK is free-riding in a big way, as it never paid for the cost of educating and training those workers.)

When I take those political affiliation surveys, I always say I’m willing to pay higher taxes. But now the devil on my shoulder is saying “why should you pay higher taxes to replace the taxes that were paid by EU migrants? Those idiots have brought it on themselves, let them now suffer the consequences”. An ugly thought, but I’m guessing that if I’m having it then I’m not alone. The UK’s EU referendum has eroded social trust more than immigration per se ever did. It poses the question of what citizens owe to one another in pretty stark terms. If people could mitigate the need for higher taxes by accepting immigrants and they choose not to do so, why should their wealthier fellow citizens bear the cost of their choices?

Branko Milanovic advocates reinventing apartheid

In an op-ed in the Financial Times, the economist Branko Milanovic [advocates that](https://next.ft.com/content/2e3c93fa-06d2-11e6-9b51-0fb5e65703ce) in order to fight global poverty, we should introduce explicit systems of differentiated citizenship in wealthy countries under which immigrants (and their children? and their children’s children?) would be entitled only to a reduced package of rights. He argues that we should

> redefine citizenship in such a way that migrants are not allowed to lay claim to the entire premium falling to citizens straight away, if at all. Restricting the citizenship rights of migrants in this way would assuage the concerns of the native population, while still ensuring the migrants are better off than they would be had they stayed in their own countries. As happens currently in the Gulf states, migrants could be allowed to work for a limited number of years, or to work only for a given employer, or else be obliged to return to their country of origin every four or five years. They could also be made to pay higher taxes since they are the largest net beneficiaries of migration. Despite such discriminatory treatment, the welfare of migrants and their families would increase, while native populations would not be made to share their entire premium with incomers.

*Gastarbeiter* with second- or third-class status, perhaps forever. Now, I’ll say one thing for this proposal, which is that it would formalize something that currently exists, since in all wealthy countries there exists a layer of poor people (including many migrants) who enjoy only semi-citizen status (as [Elizabeth Cohen has documented](http://www.cambridge.org/gb/academic/subjects/politics-international-relations/political-theory/semi-citizenship-democratic-politics) ). And this layer, though many individuals pass through it and come out the other side, looks like a permanent feature of our societies. Up to now, however, few people have thought of this, and the consequent denial of rights to individuals and their vulnerability to domination and exploitation, as a good thing. Milanovic wants us explicitly to abandon the liberal and democratic principles of legitimacy that those who are subject to the laws of a society should (in time in the case of migrants) get to have the right to make those laws. In doing so, he goes far beyond similar proposals (for example [from Martin Ruhs](http://www.priceofrights.com/) that have been explicitly temporary in nature and have largely focused on labour-market rights. Milanovic’s lack of commitment to the norms of liberal democracy also comes across in the fact that he holds up illegitimate and tyrannical states, such as the Gulf kleptocracies, as models for his proposed policy. Part of what’s going on here is the economist’s perspective on policy, which just focuses on net improvements in well-being or utility, with income serving as a proxy, and which doesn’t, therefore, see human beings as possessed of basic rights which it is impermissible to violate. Rather, all and any rights can be sacrificed on the altar of income improvement, just in case someone is poor and desperate enough to make a deal (who are we, paternalistically, to stop them?). The road to hell is paved with Pareto improvements.

Expatriation and duties to compatriots

I’ve been teaching brain-drain related issues this week. Some of the big questions there are empirical ones, and the facts are contested. But some of the normative issues are interesting, and some of them don’t just apply to poor countries. One of these issues is the apparent clash between our duties to compatriots (if we have any) and our rights of exit and expatriation. If I have a duty as a member of an institutional scheme to contribute to the well-being of the least advantaged members of my society, can I just divest myself of that duty (in one bound, as it were) by leaving the country, or, to go one step further, by renouncing my nationality? It was a puzzle that Henry Sigdwick was defeated by back in 1907 [or somewhat earlier in fact, as he died in 1900!]:

> `In 1868 it was affirmed, in an Act passed by the Congress of the United States, that ‘the right of expatriation is a natural and inherent right of all people.’ I do not know how far this would be taken to imply that a man has a moral right to leave his country whenever he finds it convenient—provided no claims except those of Patriotism retain him there. But if it was intended to imply this, I think the statement would not be accepted in Europe without important limitations: though I cannot

The English columnist Nick Cohen had [a piece on immigration in yesterday’s Observer](http://www.theguardian.com/commentisfree/2016/feb/06/liberals-harsh-truths-help-refugees-syria). For those who don’t know his work, Cohen is a former left-wing radical journalist who has now renounced “the left” for its supposedly regressive views and who, post-epiphany, lashes “liberals” and others in the pages of the Spectator and Standpoint. A Paul Johnson for a new generation.

His latest effort is full of his trademark jibes that “the left” is soft on Putin, together with swipes at stock figures such as the “no-platforming student dogmatist”. But let’s leave the fluff and the fury aside and concentrate on the substance of his piece.

EU to criminalize those who rescue drowning refugees?

There is disturbing news via Statewatch that the [EU is drawing up plans to criminalize](http://www.statewatch.org/news/2016/jan/eu-med-crisis-criminalising-civil-society.htm) the many independent volunteers who have been working in Greece to assist refugees making their way from Turkish to Greek territory. The plans involve a deliberate conflation of “people smuggling” and “trafficking” and a requirement that all volunteers be registered and placed under the control and direction of state organizations at designated hotspots. Those who stay outside of these structures and go to the beaches where people are actually arriving and assist them by, for example, towing their boats, will be prosecuted. In fact, this is already happening [in the case of some Spanish lifeguards on the Greek island of Lesvos](https://libcom.org/forums/news/lesvos-chios-volunteers-helping-refugees-arrested-police-frontex-involvement-interna). There is [a petition](https://www.change.org/p/council-of-the-european-union-scrap-plans-to-criminalise-refugee-rescue-operations?recruiter=28957283&utm_source=share_petition&utm_medium=facebook&utm_campaign=autopublish&utm_term=des-lg-share_petition-no_msg&fb_ref=Default), which I’ve signed, though internet petitions are not a particularly effective means of resistance.

Only two months ago Europeans were shocked by the picture of Aylan Kurdi, the three-year-old Syrian refugee lying dead on a Turkish beach. Then, there was a profound sense that more should be done to help people fleeing Syria’s civil war. Now, in the immediate aftermath of the ISIS murders in Paris and with unconfirmed reports that at least one perpetrator may have travelled through Europe disguised as a Syrian refugee, there are loud calls to close our doors. For some of Europe’s politicians, such as UKIP’s Nigel Farage, Marine Le Pen of France’s Front National, and the new right-wing Polish government, enough is enough: refugees trying to get to Europe should be stopped and nobody should be resettled here. There are demands for Schengen to be abandoned, together with current rules about freedom of movement within the European Union. In the United States, a similar debate is playing out, as a number of Republican governors, Presidential candidates and members of Congress push back against President Obama’s plans to welcome thousands of Syrian refugees. With so many in Europe and across the world outraged at the atrocities in Paris, these voices will be seductive, but if heeded they will lead us towards policies that would be profoundly mistaken and counterproductive.

Clamping down on refugees fleeing the region will not prevent acts of terror. In the European case, if ISIS and similar organisations wish to engage in further attacks, they do not need to bring anyone in from Syria to do so. The perpetrators who have been positively identified turn out to have been lawful residents of France and Belgium.

Cultural anxieties about migration

This is more of a bleg than a post, I’m looking for contradiction. One of the often-claimed worries about immigration is of cultural loss, that the incomers will overwhelm the natives who will then lose the distinctive identity that they value. Supposedly, open borders would lead to the erosion of difference, people would lose their countries, and be bereft. But thinking about it, I’m struggling to think of *any* cases of cultural extinction due to the kind of immigration that results from individuals and families simply choosing to move to another country for a better or different life. Open borders within Europe haven’t caused the Germans and French to disappear. Open borders within the UK (and with Ireland) haven’t led to the demise of the Scots, the English, the Welsh or the Irish. And such immigrants as have come, have just turned into regular folks with slightly unusual names or atypical appearance within a generation. Not that there haven’t been historical cases of some peoples chasing out or killing other peoples, of course there have. But all the instances — at least all the modern ones — I can think of are *state-sponsored projects* of colonialism, genocide, forced relocation and the like. In the absence of deliberate state action and political mobilization, peoples of ethnic, cultural, religious, or linguistic distinctiveness seem to be pretty robust entities. Though Henry Sidgwick and Michael Walzer seemed to think they needed borders and border control to preserve themselves, mostly they don’t.

The migration industry

If you want to understand what’s going on in the world of migration, one thing you need to do is to read [Hein de Haas’s blog](http://heindehaas.blogspot.co.uk/). His [latest post](http://heindehaas.blogspot.co.uk/2015/09/dont-blame-smugglers-real-migration.html?m=0) is a sharp corrective to the people who believe that the smugglers are to blame, that inward migration threatens cost the taxpayers on wealthy nations billions, that the solution to the desperate people from the Middle East or Central America is to build bigger and higher fences and to militarize our borders. As he argues, increased border security simply generates a market for the services of smugglers to evade the new measures, and pushes desperate people to seek even more dangerous routes. This, in turn, leads politicians to pledge more border security, leading the cycle to repeat itself.

Who profits from this? Not migrants or refugees, certainly. The smugglers, a little. And the big contractors and militarized agencies who “defend” the borders, run the detention centres and other facilities a lot. And the people who are paying for all this financially are the citzens of wealthy nations who then get a “solution” that makes the problem worse.

We urgently need to explore alternatives, such as flying refugees to Europe, as [Alexander Betts argued in the New York Times](http://www.nytimes.com/2015/09/25/opinion/let-refugees-fly-to-europe.html?_r=0) the other day.

A migration veil of ignorance

I’ve been invited to give a TED-style talk tonight on whether there’s a right to free movement. Given the format, I don’t have a text and I’ll be speaking to a series of slides. But here are the basic points I’ll be making, for better or worse. (There’s no great claim to originality here, and my final slide will tell people to read Carens. Lots of undotted “i”s and uncrossed “t”s too.)

At the present time, they key norm governing the international migration regime is that states have a discretionary right to allow or not allow non-members onto their territory and to grant such members rights of residence, or not. The global refugee and asylum regime is a partial exception to this rule, but only a partial one because states have voluntarily agreed to be bound by the provisions of the Convention and could, if they chose, renounce it.

Clearly, most politicians and most voters, at least in rich countries, believe the norm is justified, with a lot of public debate focusing on whether the refugee regime is too permissive. Any party that tried to run on a policy favouring more open borders would get slaughtered at the polls, because more people think that democratic electorates have the right to exclude. But just because most people believe something, doesn’t make it true. And past consensuses on slavery, women’s suffrage and against gay marriage now look like the moral abominations they are.

But border and citizenship regimes have a *prima facie* case to answer because of the fatefulness of citizenship for life chances and the way in which they coerce people. Whilst some people are lucky enough to be born in, say, Belgium, others have the comparative misfortune to end us as citizens of Burundi or Bolivia. Some people get the valuable citizenships of states with wealth and which respect human rights; others end up with North Korea or Eritrea.

David Frum on the crisis in the mediterranean

David Frum is a US pundit, who writes on US politics. So, being based elsewhere, I don’t usually pay a lot of attention to him. Unfortunately, today, somebody drew my attention to [this article in the Atlantic](http://www.theatlantic.com/magazine/archive/2015/07/closing-european-harbors/395321/) in which he argues, as a prelude to some boilerplate anti-immigrant conservative points, that the people who are crossing the Mediterranean are economic migrants rather than genuine refugees. Although there’s a rather dismissive mention of Syrians at the beginning of the piece “just 30 per cent” (30 per cent of a large number is a lot of people), the message of the piece is clear. Frum calls in aid the Canadian journalist Doug Saunders, who knows his stuff and usually writes sensibly on immigration matters.

Migrant deaths: who is responsible?

Yesterday, in response to a series of tragedies involving migrants drowning in the Mediterranean, the EU issued [a ten-point plan](http://europa.eu/rapid/press-release_IP-15-4813_en.htm?locale=en) with a lot of emphasis on taking action against people smugglers and a range of further measures, such as fingerprinting migrants, that seem irrelevant to events. British Prime Minister David Cameron, whose government last year refused to back search and rescue plans on the grounds that they encouraged people to take risks, is now [blaming](http://www.bbc.co.uk/news/uk-32382962) “the human traffickers and the criminals that are running this trade.” The one group European politicians are not blaming, by and large, is themselves. Yet they, and the electorates they appease, bear most of the responsibility.

The reason for this is simple, and it is obvious. All European states are signatories to the Refugee Convention and that places obligations on them to offer sanctuary to people who arrive on their shores and who have a “well-founded fear” of persecution (on various grounds). Although politicians like to claim that their countries have a proud history of taking in the persecuted — as Cameron claimed in a speech last year — they now do everything in their power to make it as hard as possible for those seeking asylum to arrive on their territory. Devices such as heavy financial penalties on airlines and other carriers and ever tighter visa restrictions mean that people fleeing countries such as Syria and Eritrea simply cannot arrive in Europe by safe routes, and if they do so by using false documents they are often prosecuted and imprisoned. People from these countries make up a significant proportion of those trying to cross from Libya to Italy. Because people cannot travel via safe routes, they travel via dangerous ones, just as they do in other parts of the world. They put themselves in the hands of people smugglers and they take the risk of crossing the Mediterranean in flimsy boats. But the people smugglers, though no doubt unscrupulous criminals on the whole, are simply responding to a demand that European politicians and their electorates have created.

There is more. Whilst politicians from all of Europe are culpable, many those in northern Europe are particularly so. They have put in place a system in the EU that means that those people who do arrive and claim asylum must do so in the country they first enter. It is very hard to enter the UK, and most of those arriving turn up in countries such as Italy, Greece, Malta and Spain, southern European countries hardest hit by the economic crisis. Countries such as the UK can disclaim responsibility and have no incentive to agree to a fair system of burden sharing.

Fingers pointed at people-smugglers and “traffickers” are pointed in the wrong direction. Europeans need only look in the mirror to see those responsible.
