Passports and Brexit

I was looking over this post from 2016, on the consequences of a relatively successful Brexit

I’m finding it hard to see that anything will happen to justify the massive effort involved. The Poles and other EU citizens whose presence was the biggest single justification for Brexit won’t go away. On the contrary, it seems pretty clear that all EU citizens will get permanent residence, even those who arrived after the Brexit vote. Even with a hard Brexit, the benefits of consistency with EU regulations will be overwhelming. The terms of any trade deal with non-EU countries won’t be any better than the existing EU deals and probably worse.

Even symbolically, what’s going to happen? Typically, national independence is marked by a ceremony where the flag of the imperial power is lowered, and the new national flag is raised. But, from what I can tell, the EU flag is hardly ever flown in the UK as it is. The same for national currency, passport, official languages and all the other symbolic representations of nationhood. So, after a successful Brexit, Britain will be a little poorer and more isolated than before, but otherwise largely unchanged. Will that count as success in the eyes of those who voted to Leave. I don’t know.

Most of that still looks about right. But as commenters at the time pointed out, I was wrong about passports. One of the big things Leavers disliked about the EU was the replacement of the blue British passport with EU burgundy. It turns out that the colour change wasn’t compulsory, and the reintroduced blue passports will be printed in France, but at least that is a symbolic win for the Brexiteers.

On the other hand, how does this fit with the oft-repeated claim that Leave voters were “left behind” “stayers”? To be nostalgic for blue passports, you would presumably need to have undertaken a fair bit of international travel before 1988, when they were replaced. That experience, combined with the assumption that Britain is far superior to the EU, sounds like the profile of a stereotypical well-off, middle-aged or older, Tory voter. And, as far as I can tell, it was this category that provided the core support for Leave. That’s consistent with Trumpist voting most places in the English speaking world.

Could the Queen sack Johnson? Would she?

Having vague ideas of Parliamentary supremacy, I’m struck by reports that Boris Johnson could simply ignore a vote of no-confidence, and remain office to push through a No Deal Brexit, even in the face of legislation prohibiting such a course of action. As far as I can tell, these arguments are based on the premise that Parliament must nominate an alternative, and the assumption that neither Corbyn nor anyone else would prove acceptable to a majority. (Update: On more careful reading of the linked article I see that the new boss, Cummings, saying that Johnson could, for which I read would, ignore a vote for a new PM).

That might be true, and then again it might not. The question that occurs to me is whether Johnson could also ignore a vote in favour of a new PM, and if so, what could be done about it? One possibility is that the Queen could dismiss him, and invite the new PM to form a government, which would presumably hold immediate elections.

That, pretty much, is what happened in Australia in 1975, though the government’s position was far more tenable than in the hypothetical that I’ve outlined above. The government had a majority in the House of Representatives (our equivalent of the Commons). However, the government was unpopular and the Senate (similar to the US Senate in most respects) refused Supply, creating a financial crisis. The Governor-General (representing the Queen) sacked the PM (Whitlam) and installed the Leader of the Opposition (Fraser) in his place. Fraser called an election and won.

I honestly have no idea whether if Johnston refused to go, he could be removed, by the monarch or otherwise. For that matter, could he get the Queen to prorogue Parliament indefinitely, and govern by decree? That sounds inconceivable, but maybe only in the sense of Vizzini in the Princess Bride.

It’s worth noting that the absence of a written constitution isn’t the critical issue here, or at least not to the extent often claimed. Australia has a constitution, but it’s silent on all the relevant issues (it doesn’t even mention the office of a PM).

The missing question

Yesterday’s All Things Considered story about Brexit was a remarkably insidious piece of journalism. Their man in Albion visited the town with the highest Brexit vote in Britain (a ‘namesake’ of Boston Mass: the fact that they have the same name is, no doubt, a remarkable accident), managed to find a woman who voted for Brexit, and asked her what she thought of the Prime Minister’s decision to restrict the sovereignty of the elected parliament (not the way he put it). She was enthused “If that’s what it takes…then so be it”: Brexit has to be done and dusted because we’ve got to ‘slow and control” immigration. She freely admitted that Brexit would be bad for the economy, and he asked if she cared that it will be bad for her business. It as already been bad for her business, which relies on EU migrant labor, but that is something she was, nobly, willing to put up with. But what she was willing to put up with in order to slow and control immigration is entirely uninteresting. The question he didn’t ask was how she justified wrecking other people’s businesses and the businesses that other people who are worse off than she is work for. Next time, please present her with some remainers who are going to lose their livelihoods because of Brexit, or the non-trivial number of remainers who will lose their lives because the health service is understaffed (or just badly staffed) and ask her to justify the costs she is trying to impose on them. (Brilliantly, when I looked for the story to link to, I got an ad for an interview with the repulsive James Dyson).

It was the wildest science fiction, depicting a future Ireland miraculously transformed into a technological superpower. Vast highways crisscrossed the Irish countryside. The discovery of cheap contraception (manufactured from turf) broke the control of the Catholic church. A shining new city, organized around the principles of scientific discovery, was constructed on the shores of Caragh Lake in County Kerry. Britain was left on the sidelines, wondering what had happened.

Tactical Voting

In the very unlikely event that you, a CT reader, will have a vote in deciding the United Kingdom’s next Prime Minister, and haven’t made up your mind, you could do worse than listening to various of the candidates discussing ‘political thinking’ with Nick Robinson. I don’t listen to the Today programme, and have no other real exposure to Robinson, and, in general, dislike the underlying premise of Political Thinking that looking at people’s childhood and youth tells you something useful about their political thinking. What is good about the podcast is Robinson’s other premise which is basically that in the long form interview it is very hard for politicians to disguise who they are. A typical pattern — Dominic Raab, Steve Baker and Esther McVey all comform — is that they start out seeming reasonable and perfectly decent but end up seeming either nuts (Baker), poisonous (McVey) or both (Raab). [Of course, plenty of interviewees (eg David Lidington, Stella Creasey, David Gauke) end up seeming exactly as they did at the beginning — smart, serious, decent]. It is no accident, as Robinson knows, that the most likely future PM has not yet chosen to appear on the show.

Anyway, down to business. There was talk at the second stage of the vote that the repulsive Johnson’s campaign might “lend” votes to Hunt so that Boris would face him rather than someone else in the run-off among the members, thus giving him an easier time than he might have against another contender. Whipping

If you were an MP, and your party was in government, and it proposed a motion, but promised that you could have a free vote on that motion, but then at the last minute whipped you to vote against a slightly modified version of that same motion (the motion it, itself, had proposed, minus one statement of fact which, though removed, everyone knows still to be a fact), how long would it take you to get back to your constituency and prepare for a general election? And, more generally, what would you be thinking?

And, does this count as a victory for May? The motion she proposed passed, after all, despite her orders for her party to vote against it.

The UK takes a step toward tyranny

The UK Home Secretary, Sayid Javid, has decided to revoke the citizenship of Shamima Begum, who notoriously travelled to Syria at the age of fifteen with two companions and married an ISIS fighter. She is now in a Syrian refugee camp, has now given birth to a child and was reportedly keen on returning to the UK. Begum has given interviews saying that she regrets nothing and that she wasn’t “fazed” by seen the severed heads of those murdered by Daesh. Not an appealing character, but, given that she was groomed as a child by a criminal gang, one who might have been seen as a victim in other circumstances.

The UK government has given itself the power to deprive people of citizenship where this is “conducive to the public good” but the law up to now had been that they had to be satisfied that the person would not be rendered stateless. After all, as we know, if citizenship is the right to have right, statelessness is a condition of near rightlessness. In the present case, they seem to be claiming that a person born in the UK who acquired British nationality at birth can be deprived of citizenship because she is entitled to Bangladeshi nationality through her mother. Shamima Begum has never been to Bangladesh and has no connection to the country. Though her case involves terrorism the UK has also begun to use citizenship deprivation in cases involving “serious criminality”, a vague category that is capable of being defined downwards (as it was when Javid spoke about a group of people recently deported to Jamaica).

Millions of people born in the UK and holding British nationality currently have “access to” another citizenship. It may be Irish citizenship (the entire nationalist population of Northern Ireland!). It may be Israeli citizenship through the law of return. It may be the citizenship of some country in Britain’s former empire, such as Bangladesh. The new expansions of citizenship deprivation theoretically expose all of them to the possibility of exile and banishment to another country should they be convicted of serious crime. The immigration regime has long been one where the rule of law is muted, where due process is little more than what the government says it is, and where means of appeal and assertion of rights are limited. By bringing millions of people into the ambit of such a regime, you render them exposed to a system of arbitrary punishment decided upon by a minister. There are two ways to look at this: either millions of ordinary people are subject to tyranny, or they would never do that to ordinary white people, only to those with a “funny tinge”. Either way lies an appalling vista.

If Brexit goes ahead, say goodbye to radical redistribution

Here were are, at the edge of the Brexit precipice, and I find myself disagreeing with friends about Jeremy Corbyn and his attitude towards it. It is surprising that, with three months to go, we don’t actually know what that attitude is. Some people think he’s playing a long game, or a super-clever n-dimensional chess match aimed at keeping Labour voters in the north of England who backed Leave on-side. Some think he’s just reiterating Labour Party policy (to push for a general election, but keep a second vote on the table as a possibility). Others think he was a closet Brexiter all along. My own view is that we have less than 100 days to stop this thing, that the time for keeping your powder dry until you see the whites of their eyes etc has passed, and that passionate Remainers need some signal, at a minimum, to keep them voting Labour and that if they don’t get it, then Corbyn’s prospects of leading a radical Labour government are gone: they will defect to Lib Dems, Greens, Nats or (a few) even to the Tories if Labour doesn’t reposition on Brexit.

In fact, I think the Tories (or maybe right-wing anti-redistributionist politics more generally) will do rather well out of Brexit – if it goes ahead – and it will be the end of Labour. The reason why exposes a contradiction in the position of those on “the left” who have positioned themselves as pro-Brexit, or not-really-arsed-about-Brexit, together with the people who sometimes refer to themselves as “left” but clearly aren’t (Goodhart et al). I’m thinking of all those who make a big deal about “left-behinds”, “somewheres v anywheres” and “(white) working-class community”. For these people, the vote to Brexit was a spasm of pain from those who had been too-long been ignored by the “liberal elite”. To be sure (at least now) Brexit might come with an economic hit, perhaps of 4 per cent of GDP, but the redistributionist capacities of the state are still intact and we can do something about Britain’s very real social problems (170,000 homeless households) and make the UK a more inclusive and equal society, even by the economic envelope Brexit leaves us with. Besides, a second referendum, needed to give remaining in the EU any democratic legitimacy, would be a nasty and xenophobic affair, sure to sow division and hatred.

Here’s where that goes badly wrong. A redistributionist politics needs the support of millions of middle-class “liberal” Remain voters to succeed. What those who say we’ll-take-the-hit-and-redistribute are asking us to imagine is that those people will, *in sufficient numbers*, support redistribution to those whom they identify as having, by voting for Brexit, just made them and their families worse off. Not going to happen. A staple of Blue Labour/Goodhartian thought is that immigration and increasing ethnic diversity has made it hard to sustain social trust and that this risks undermining support for welfare-state institutions. The thought is that people need to be committed to the idea of an inclusive national community if they are going to be motivated to make sacrifices on behalf of others in the form of economic transfers: they won’t stump up for people who are too unlike themselves. But by fighting a culture-war against immigration and the “liberal elite” in order to secure Brexit, those Blue Labour types have succeeded in destroying the illusion of an inclusive national community. They have produced two hostile camps, ranged against one another, who will be unwilling to make the payments those very leftists think are necessary.

I confess that I myself have had some ugly thoughts as a result of the Brexit experience: why should I pay taxes to bail out a bunch of racist idiots in Sunderland or Stoke? What do I care if some elderly xenophobe can’t find a nurse or a doctor because too few EU nationals have stayed to look after the people who voted to take their rights away? Usually, I put away such thoughts: the homeless in the doorways of our major cities provide urgent enough reason for a redistributive and reconstructive politics. But enough people will stick with their anger and resentment against Brexit for disaffected Remainers to be electorally significant. There will be no healing of the division, no national coming-together. Corbynite tweeters will rail against the selfishness of middle-class people who won’t vote Labour any more. Maybe they’ll have a point. But the fact is they need the targets of their anger to vote with them rather than for an individualistic set of policies that abandon the worst off. The future looks surprisingly bright for people like George Osborne and the Orange Book Liberals, and the left has stuffed itself, again.

A question about referendums

If you want to discuss Brexit, what’s going on, etc, please go to JQ’s thread. I have a question for those of you who know about referendums (referenda?) and/or surveys either through study or experience.

Several times recently, I’ve heard politicians say that it is obvious that a 3-option referendum is impossible. The obvious reason they say this is that they want to ensure that the (from their point of view) worst option is off the table: Brexiteers want “this deal or none” and Remainers want “This deal or stay”. Sensible enough. But, is there any other reason not to have a 3-option referendum, in which people rank their preferences, and if no option gets a majority, the second preference of those whose option comes third get redistributed?

Obviously its possible. I can think of actual reasons why it might be undesirable (eg, maybe people can’t cope with three options, or maybe there’s a reason to think that there’s something undemocratic about it, or that Current Deal would lose against either No Deal or Remain in 2-way votes, but would beat both of them in a 3-way vote even with 2nd-preferences redistributed), but have no idea whether these reasons have any basis in reality.

Brexit: this is it?

Since the Brexit referendum was hailed by many as representative of a new force in global politics, it’s of interest even on the far side of the planet, and I’ve watched the slow-motion train wreck with appalled fascination.

So, as far as I can tell, the Brexit deal Theresa May has come up with is pretty much the super-soft version. About the only immediate change it will produce is a return to blue passports in place of the EU burgundy, which, it appears, were always optional. And, it appears, the new passports will be printed in France.

All that assumes that the deal will go through. In this context, I’ve been struck by a lot of commentary supporting the deal on the basis that a second referendum isn’t feasible due to the timing requirements of the Referendums Act. Am I missing something here? Isn’t Parliament supreme? And given that this issue has consumed British politics for the last two years or more, can there really be any significant ambiguity about the possible choices articulated by May today: her deal, no deal or no Brexit?

Time to join the generation game?

As regular readers will know, I’ve spent a generation or more [1] deriding what I call the generation game – the idea of dividing the population up into birth cohorts (categories based on year of birth) such as Boomers, X-ers and so on (Millennials weren’t invented when I started) and assigning them various supposed characteristics. Most of the time, this exercise is little better than astrology. To the extent that there is any semblance to reality it simply reflects the fact that young people are, and always have been, different from old people.

But just as I have managed to get some traction with this idea, genuine cohort effects have emerged in politics in many countries. The sharpest case is Britain, where people over 65 voted massively for Brexit in the referendum and the Conservatives in the recent election, while those aged 18-24 went even more sharply the other way. As the map linked here shows, if only 18-24 year olds were voting, based on current polling data, the Conservatives would not have won a single seat[2]. If only those over 65 voted, the Conservatives would win 575 and the combined opposition 54.

This is a massive difference and can’t AFAICT be fully explained by differences in education, ethnic composition and so forth. It also represents a huge shift on the part of older cohorts, who were part of the electorate that gave Labour three terms not long ago. While there is some tendency for people to become more conservative as they age, it’s normally much more limited than this.

The explanation in simple terms, is Brexit. Most of the time, elections involving competing visions of the future. In the UK case, from the 1990s until Brexit, the contest was between hard-line Thatcher-style neoliberalism and Third Way Blairite soft neoliberalism. In the course of such debates, both sides routinely claim to be on the right side of history, to own the future and so on.

By contrast, Brexit represented an appeal to a (partly imaginary) past, against the present and the future. With the exception of a handful of neoliberal ideologues, who saw Brexit as a path to a free-market future, most Leavers were motivated by nostalgia for the glories of the past, and were willing to sacrifice the interests of the young to make a gesture in that direction.

What’s true of Brexit is true, though not to quite the same extent, of the culture war politics that have now become dominant on the political right in much of the English-speaking world. It’s driven in large measure by old men who lost the cultural battles of the 1960s and 1970s, and have never got over the fact.

The result is a situation where the right is appealing directly to members of older age cohorts with the result that younger cohorts are moving left. The most immediate effect has been to wipe out the support base of centrists of the Blair-Clinton-Keating type, who fail to appeal to either group.’m

Cliff edge ahead!

In the early days of Crooked Timber, I think we took ourselves to be under some kind of obligation to react to major current events. That’s rather fallen by the wayside. During the era of Trump and Brexit, I find the thought of having to write about every absurdity and injustice just too damn depressing. But today is one of those moments in British politics that perhaps ought to be marked, since we have had the resignations of David Davis and his deputy Steve Baker at 11.59 last night (DExEU’s Midnight Runners as social media has it) followed by the opportunistic self-release of Boris Johnson into the community today. What has brought this about is a ticking clock. The fact that under the Article 50 process, the UK crashes out of the European Union in March next year. The Tory party have wasted most of the two year process, running a pointless general election then arguing with one another, but failing to negotiate with the EU’s team because they couldn’t agree a common position. Faced with the warnings from industry, the prospect of queues at the ports, empty supermarket shelves, supply chains severed and planes unable to land, those Tories who still have connections outside of the Brexit fantasy have prevailed on Theresa May to put together something that might be at least the start of a solution (even if it looks unacceptable to the EU in its current state). But since May’s Chequers compromise envisages at least having the minimum conditions in place for continued trade with a much bigger partner, that inevitably involves accepting that the UK will have to swallow the EU’s way of doing things. The UK has walked away from a table where it had a powerful voice and put itself in a position where those left around the table get to dictate terms. All too much to bear for the true believers in Brexit and for those who think their future careers depend on ingratiating themselves with the true believers. Cliff edge ahead.

“Illegal”

In discussion of my recent post about the Windrush scandal, a couple of commenters used the phrase “illegal immigrants”. Tory ministers have since been on the airwaves using it a lot, and telling us that the public expects action on “illegal immigration”. Labour’s Diane Abbot has also been talking about the need to “bear down on illegal immigration” and the journalist Amelia Gentleman, who did so much to break the Windrush story, has protested that scandal of citizens denied their rights is nothing to do with “illegal immigration”.

But here’s why what they all say is wrong. There’s no such legal category as “illegal immigration”, rather there are people who have the legal right to be in the country and, perhaps, to do certain things like work or study. And then there are people who *may* lack the legal right to be present and to do those things. Some of the people with legal rights to be present have those rights because they are citizens; some other people have those rights for other reasons such as having a valid visa, being a refugee, or having some other human rights-based legal basis to stay.

Obviously, to “bear down” on people without the legal right to stay a government needs to (a) determine who they are and (b) take some action against them. Equally obviously, a government official may make a mistake about whether a person has the right to stay or they may use impermissible means against them. So you need a system by which people who have the right to stay but who the government wants gone can contest the bureaucratic decision against them as mistaken.

During the past term, I was on strike for fourteen days and I’m now on “action short of a strike” and, like my colleagues up and down the UK, I’m waiting to vote in a consultative e-ballot next week that may determine whether we reach a settlement with the employers and go back to work. But this post isn’t about the rights and wrongs of the dispute, it is about what it has felt like to be on strike — the highs and the lows — and about how the shared desire for a better university that has emerged from our unity and solidarity may be helped or hindered by how the strike is resolved and by the stories we tell ourselves about it.

A big part of striking (at least for those who choose not to sit at home) is picketing. I’ve been on picket lines (a long time ago) where the purpose of picketing was to stop people from going to work, but our picket lines now have been more symbolic and demonstrative. They’ve been about standing together, feeling a sense of comradeship, and sharing jokes and conversation. In this we’ve been joined by many of our students, giving rise to a renewed feeling of the university as an intellectual community bringing together teaching and research staff, other university staff and students and joining us together across disciplinary boundaries. This experience, together with associated demonstrations, teach-ins lunches, coffees and social events, has been the source of a growing sense of collective determination that a different kind of university is possible and that we mustn’t go back to the normality of submission to bullying micromanagement, the obsessive chasing of metrics and rankings and individualized anxiety and self-loathing.

Why do people keep saying that a bad agreement is worse than no agreement? They — not just May and her friends, but reasonably serious journalists — say it as if it means something. Isn’t it just the truism that an agreement that is worse than no agreement is worse than no agreement? Why is that observation relevant to anything? Everyone knows it is true, including the EU negotiating team. So the EU negotiating team is not going to try for a worse-than-no-agreement agreement, because they know that if that is the best on offer the UK can just walk away into WTO rules. So the observation that a bad agreement is worse than no agreement has no bearing on anything that anyone should do.

I’m missing something, right? [1] What is it?

[1] Really. I’ve been puzzling about this a while. I suppose an email to Henry should clear things up, but its more fun to open it up on CT, even at the cost of exposing myself as obtuse, which I obviously am being.
