Assuming that the “vacancy” at issue is for “Libertarian with (comparatively) strong Democrat sympathies”, I’m seeing Kerr having filled the Jacob Levy vacancy, and any future filling having to come from the outside.

Randy would have to move too far left, and his vacancy would be harder to fill. I’m picturing someone along the lines of Will Baude from Crescat, or one of the co-bloggers from Concurring Opinions.
