Robert Lemieux has an interesting analysis of the decision of the Canadian Supreme Court to strike down a Quebec law forbidding the sale or purchase of private health insurance. I’m not sure if the _Lochner_ analogy isn’t a little strong, but this does seem to be a worrying precedent, whatever the substantive merits of the decision.
