A lot of our politics is about symbolism. And symbolically intellectual property represents itself in the contemporary United States as a kind of property—it’s right there in the name. But it’s better thought of as a kind of regulation. Patents and copyrights are modeled, economically, the same as you would model any state-created monopoly.
I think the idea that intellectual property is property is too entrenched, at this point, for this to be an effective rhetorical strategy. Furthermore, rhetoric aside, philosophically the real breakthrough would be for people to realize that defending property rights is not tantamount to defending freedom. What strong IP protection generates is not a free market but something more like information feudalism: a market-unfriendly clusterfuck of fiefdoms and inescapably inefficient lord-vassal terms-of-service arrangements that any friend of freedom, in any ordinary sense, ought to look upon with disgust. The reason why libertarian rhetoric – defend property rights! – can underwrite feudalism, of all things, is that a certain sort of libertarianism, i.e. so-called propertarianism, really just plain is a form of feudalism. I’ve made the case at length.
I don’t see much hope of making a snappy rhetorical case that would break the unhealthy property = freedom link. But I think it might actually be possible to sidestep it by coming up with something like ‘information feudalism’ or ‘cyberfeudalism’ as a catchy term for IP rent-seeking or patent trolling. (Of course, ‘rent-seeking’ and ‘patent trolling’ are already pretty snappy.) To put the point another way, lots of folks are so averse to ‘government regulation’ that you will never get them to trade ‘private property’ talk for ‘regulation’ talk, as Yglesias suggests. But really what these folks are operating with is a kind of centralized = lots of regulation; decentralized = deregulated mental shortcut. The advantage of ‘feudalism’ would be to break that by making vivid the obvious possibility that decentralized stuff can still be too highly regulated, in effect.

Teaching ‘Philosophy and Film’ this semester, with a focus on sf, I’m amused to read this bit from a Salon piece by Michael Lind:
If there was a moment when the culture of enlightened modernity in the United States gave way to the sickly culture of romantic primitivism, it was when the movie “Star Wars” premiered in 1977. A child of the 1960s, I had grown up with the optimistic vision symbolized by “Star Trek,” according to which planets, as they developed technologically and politically, graduated to membership in the United Federation of Planets, a sort of galactic League of Nations or UN. When I first watched “Star Wars,” I was deeply shocked. The representatives of the advanced, scientific, galaxy-spanning organization were now the bad guys, and the heroes were positively medieval – hereditary princes and princesses, wizards and ape-men. Aristocracy and tribalism were superior to bureaucracy. Technology was bad. Magic was good.
He’s got the film history wrong. Metropolis came before Star Wars. Hell, so did Charlie Chaplin’s Modern Times: that’s dystopian sf. Also, it isn’t really right to say that the theme of Star Wars is ‘technology bad’. Star Wars is really more a case of lacking a ‘science good’ message. Also, Star Trek is conspicuously moderate in its pro-science thematizing. Kirk is the captain, exemplifying the properly adventurous equilibrium point between McCoy’s emotionalism and Spock’s rationalism. Hell, that’s the theme of Metropolis, too. You need ‘mediation’ and ‘moderation’ between pure science and … some more human source of meaning.

Provoked by Ta-Nehisi Coates, Matthew Yglesias ponders the difficulty adapting Gatsby, in the face of the looming 3D threat.
I agree this seems like a problem. But I think an awful lot of it has to do with the fact that Gatsby is basically crap, and I can’t for the life of me figure out why everyone disagrees with me about this. Yglesias quotes a typical bit:
Or consider: “some wild wag of an oculist set them there to fatten his practice in the borough of Queens, and then sank down himself into eternal blindness or forgot them and moved away.” How is it that Nick know for certain that Eckelburg isn’t practicing in Queens any longer but is unsure as to whether he’s moved or died?
I can answer that one. Fitzgerald is a bad writer.
Let me illustrate, by way of offering advice to aspiring 3D directors:
Usually her voice came over the wire as something fresh and cool, as if a divot from a green golf-links had come sailing in at the office window, but this morning it seemed harsh and dry.

A stray note on the history of science fiction, in relation to theatrical absurdity qua independent but relatable phenomenon, via the intermediation of McGuffins, actual and potential, scientifical, metaphysical and occasionally fistical, and suchish chickenegg castings of shadows …
The note is: Beckett’s 1930 poem, “Whoroscope”, seems like an interesting work to think about.
It also seems worth chicking and eggsamining how Beckett and co. came close to satirizing, avant lalettre, Gernsback’s glorious goose egg of a golden coinage, ‘scientifiction‘. But I see that Gernsback actually proposed the term a few years earlier, in 1926. So that would be upsetting the eggcart before the chicken. And we wouldn’t want to do that o no.
Why am I thinking these thoughts? In part because I’m reading Martin Esslin, The Theatre of the Absurd
[amazon] – on the iPad! It’s interesting. And it’s just what I wanted my iPad to do for me. Old good books re-released in inexpensive e-book format.

Man, I haven’t heard this
for a long time. Amazon has it for $1.99. A bargain for the Lips completist in your house, or even just in your cranium. Sort of got a Syd Barrett does Brian Wilson in the Midwest vibe, with real low, low feedback-y production values. In short, it sounds a lot like the Flaming Lips. I like “Ice Drummer”. Can’t even link to it anywhere. Not a YouTube video or anything. Goes kinda BAH-duh-duh-BUH-Bah-duh-duh-BUH-BAH-duh-duh-BUH-BUH-DAH. With this little twickle-twickle-TWICK guitar on top. If you can imagine it. There are lots of good songs about drummers, if you think about it. Please provide examples in comments, to prove yourself.

I think you can be as outlandish as you want or as surreal as you want, as long as the characters are based in something real. You can put them in any situation or any reality as long as their reactions have something to do with humans beings and you’re focused on that element of it. I’m not interested in necessarily doing realistic things, obviously. I like fanciful stuff. But it can’t be just fanciful without people in it. Then it’s of no real interest. If you decide that people are turning into carrots or something as your story idea, then I think that I would have to figure out why that’s important to me as a person and why that story resonates in some way. Otherwise there’s no story. It’s just a gimmick. (10)

I’m preparing to teach philosophy and film again and I’m looking for examples of films that hinge on more or less bald stipulations of metaphysically preposterous states of affairs. That is, cases in which something impossible happens, and it isn’t identified as science or magic. It just is. Examples:

I got an iPad for X-Mas so – finally! – I can get in on this e-book thing. I bought Quiggin’s Zombie Economics

Now I’m thinking about writing: Krakenomics: How Really Big Things Can Drag Down You, And Everyone You Love, To The Very Bottom, And There’s Nothing You Can Do About It, Probably. “Chapter 1: Shit Creek and the Paddle – Learning To Love Learned Helplessness”. Or something like that. But I’m too lazy to write it, so you write it. Also, I haven’t even read the Mieville yet, so what do I know?
But I’m thinking about quoting our John in something I’m writing (yes, on Zizek). But I can’t footnote a Kindle edition. No pages. What will the world come to? Bibliography has gotten a bit old and odd in the head in the age of the internet, but the existence of pages themselves is kind of a watershed. On the one hand, there’s really no reason why a text that can be poured into a virtual vessel as easily as it can be inspirited into the corpse of a tree should have to have ‘pages’. Still, it’s traditional. Harumph. I suppose I’m going to have to use Amazon’s ‘search inside’ or Google Books and pretend I read the paper version, as a proper scholar would. Or just email John Q. and ask.

Two weeks ago I noted that G.K. Chesterton had written a novel that is, as it were, the limit case of sf. A futuristic exploration of the hypothesis that nothing much will change, scientifically. I just noticed that, in What’s Wrong With The World (1910), he offers a bit of theory on the subject.
The modern man no longer presents the memoirs of his great grandfather; but is engaged in writing a detailed and authoritative biography of his great-grandson. Instead of trembling before the specters of the dead, we shudder abjectly under the shadow of the babe unborn. This spirit is apparent everywhere, even to the creation of a form of futurist romance. Sir Walter Scott stands at the dawn of the nineteenth century for the novel of the past; Mr. H. G. Wells stands at the dawn of the twentieth century for the novel of the future. The old story, we know, was supposed to begin: “Late on a winter’s evening two horsemen might have been seen—.” The new story has to begin: “Late on a winter’s evening two aviators will be seen—.” The movement is not without its elements of charm; there is something spirited, if eccentric, in the sight of so many people fighting over again the fights that have not yet happened; of people still glowing with the memory of tomorrow morning. A man in advance of the age is a familiar phrase enough. An age in advance of the age is really rather odd.
It is amusing to imagine all sf novels written in the future tense, as if their authors were squabbling prophets.

Here’s another best of 2010 comics entry for you. Cathy Malkasian’s Temperance
[amazon] is like Franz Kafka’s The Castle meets Little House On the Prairie and goes drinking. No, it’s like rewriting Pinocchio as several Flannery O’Connor short stories, including (but not limited to) “A Good Man Is Hard To Find” and “Good Country People”. No, that’s not it either. Good thing there’s an 18-page preview from Fantagraphics (pdf). And here’s a very interesting interview with the author. She talks about how, in a strange way, this whole phantasmagoric nightmare tale is a meditation on the virtue of moderation. Strangely, that seems right.
A couple years ago I reviewed Malkasian’s first book, Percy Gloom, and said I liked it but felt the author could do even better. Well, I think Temperance is better. It’s not as funny. Percy was funny. But it feels – full and complete – whereas Percy felt like it wanted to be bigger and more serious, but wasn’t, and was sort of trying to compensate for that with the funny bits. Looking back, I notice that I said Percy Gloom – the character, an ‘aspiring cautionary writer’ – was a cross between Kafka’s Hunger Artist and Elmer Fudd. I probably should have added that he’s also a cross between Charlie Brown and the protagonist of Nathanael West’s Miss Lonelyhearts. If they went to Oz. At any rate, I am consistent in my sense that, somehow, Malkasian is Americanizing the Kafkaesque. Or perhaps I am merely so impoverished, adjectivally, that I fall back on that last refuge of the inarticulate scoundrel: ‘Kafkaesque’. Anyway, it’s weird as hell. This stuff.
